These cover how orders, pre-orders, payment, shipping and returns work here. The pre-order section matters most — deposits commit us to a manufacturer on your behalf, so please read it before paying one.
01Who these terms are between
Diecast Punch is a storefront selling collector die-cast scale models, operated by [registered business name], registered at [registered address] (“we”, “us”, “our”). “You” means the person placing an order or using the site.
By placing an order you accept these terms as they stand on the day you order. If you do not accept them, please do not order. We may change these terms — see Changes to these terms for how a change affects an order already placed.
02Accounts
You need an account to check out; we do not offer guest checkout. You are responsible for keeping your password to yourself and for anything done through your account. Tell us promptly if you think someone else has access to it.
Give us accurate delivery details. We are not responsible for a delayed or failed delivery, or for a re-shipping cost, caused by an address, pincode or phone number that was wrong or incomplete when you gave it to us.
We may suspend or close an account for fraud, payment abuse, repeated chargebacks, reselling in breach of these terms, or abuse of our staff. Where we close an account with orders outstanding, we will still complete or refund those orders.
03Orders and acceptance
Placing an order is an offer to buy. A contract forms only when we confirm the order and your payment is verified — not when the order number is generated. Until then we may decline the order.
We may decline or cancel an order, in whole or in part, where the item is out of stock or our allocation is cut, the price or description was published in error, we cannot verify payment, or we reasonably suspect fraud or reselling abuse. If we cancel after you have paid, you get a full refund of everything paid on the cancelled part, including any deposit.
We list one unit price per model and may limit quantities per customer on allocation-limited releases.
04Prices and currency
Prices are set and charged in Indian Rupees. The site can display prices converted into other currencies for convenience, using a stored reference rate. A converted figure is an indication only — the amount payable is the rupee amount, and your bank’s own rate and charges are between you and your bank.
The price shown when you place an order is the price for that order and will not be increased afterwards. This applies to pre-orders too: a deposit fixes the price of that model for that order. Where a statutory tax or duty changes and applies to an order not yet dispatched, we will tell you before dispatch and you may cancel that item for a full refund rather than pay the difference.
Obvious pricing errors are not binding. If a price is clearly wrong, we will contact you before doing anything and you may confirm at the corrected price or cancel for a full refund.
05Payment
We do not take card details on this site and there is no payment gateway integrated into it. Payment is arranged separately and confirmed by us by hand, which is why a new order sits at “Verifying payment” until we have checked it. Never send payment to an account that did not come from us directly, and never share a password, card number or one-time passcode with anyone claiming to be us — we will never ask for any of those.
We start work on an order, including committing your allocation with a manufacturer or vendor, once payment is verified. Where an order needs a balance payment later, see Pre-orders and deposits.
If you think a charge is wrong, contact us first and give us a fair chance to sort it out. Raising a chargeback without doing so may lead us to suspend the account.
06Pre-orders and deposits
A pre-order is an order for a model that has not been released or has not reached us yet. Pre-orders are a large part of what we do, so please read this section before paying a deposit.
Two payments. Most pre-orders take a deposit now and the balance when the model arrives with us. The deposit is set per listing and is shown on the product page and at checkout before you pay. Some listings are billed in full up front instead — where that is the case, the listing says so and there is no later balance.
Balance. We will ask for the balance when the model reaches us. You must pay it within 14 days of us asking. If you do not, after at least one reminder, we may cancel the order and re-sell the model; in that case we will refund what you have paid less the deposit, which we keep to cover the commitment we made on your behalf.
Deadlines and open pre-orders. Some listings close on a stated date. Others stay open while our allocation lasts and close without notice when it runs out. A listing shows which it is.
Dates are estimates. Any release, arrival or delivery date on a pre-order comes from the manufacturer or vendor and can move. Manufacturers routinely revise schedules for production, licensing, tooling and freight reasons. A revised date is not a breach of these terms and does not by itself entitle you to cancel — but see the two cases below, which do.
If it never arrives. If the manufacturer cancels production, or our allocation is cut, or we otherwise cannot supply the model after reasonable efforts, we will refund everything you paid for it in full, deposit included.
If it is very late. If a model has not reached us within 12 months of the arrival date shown when you ordered, you may cancel it and we will refund everything you paid for it in full, deposit included. We may also offer this earlier for a delay we consider excessive.
Changing your mind. Outside those two cases, a deposit is not refundable and a pre-order cannot be cancelled once placed. We commit paid, non-recoverable orders with manufacturers and vendors on the strength of your pre-order. Deposits are also not transferable to another model or order.
Pre-release images. Images shown before release are the manufacturer’s prototype or reference renders and often differ from the production model in paint, tampo, wheels or packaging. The model you receive is the one as actually released. A difference from a pre-release image is not a fault.
07Shipping and delivery
Shipping is quoted at checkout from your destination pincode and the weight and size of the parcel. There is no flat rate and no free-shipping threshold. The figure shown at checkout is the figure charged. Our Shipping Policy sets out how the weight is worked out, dispatch times, tracking and what happens to a parcel that goes missing.
We dispatch with established couriers and share a tracking number once a parcel is on its way. Dispatch and delivery windows are estimates, not guarantees.
Where an order contains both in-stock models and pre-orders, we hold it and send it together once everything has arrived, unless you ask us to split it — see Shipping part of an order early.
Risk passes to you on delivery. Once a parcel is with the courier we do not control handling or timing, and we are not liable for a delay caused by the courier, weather, customs, industrial action or anything else outside our reasonable control. We will always help you chase a courier, but doing so is not an admission that a loss is ours.
You are responsible for any import duty, tax or customs charge on a delivery outside India.
08Transit cover
Loss or damage in transit is not covered as standard. Our prices do not include insurance and our shipping quote does not either.
Cover can be arranged at extra cost. Ask us before you place the order — there is no option to add it at checkout, and it cannot be added once a parcel has been dispatched.
Where you have paid for cover, a transit claim is settled on the terms of that cover. Where you have not, a parcel confirmed lost or damaged by the courier is not something we refund or replace.
09Shipping part of an order early
When some of what you have bought is ready and the rest is not, you can ask us to send the ready part now rather than wait. This is a request, not a right: we may decline it, and we may withdraw the option at any time.
Splitting a shipment means more than one parcel, so it usually costs more to send than a single combined one. Where an approved split changes what is owed, we will tell you the difference before we dispatch anything.
10Discount codes
A discount code may be limited by expiry date, total or per-customer use, minimum order value, or the products it applies to. Codes have no cash value, cannot be exchanged for cash and cannot be applied to an order already placed. We may withdraw a code, or refuse one that has been shared publicly, used in bad faith, or obtained in error. One code per order unless we say otherwise.
11Condition, packaging and collectible variation
We sell factory-sealed models unless a listing says otherwise, and we check parcels before dispatch. Die-cast models are mass-produced collectibles and normal variation between examples of the same model is not a fault. That includes minor paint and tampo variation, slight misalignment, small casting marks, glue traces, wheel alignment, and shelf wear on packaging such as creases, dents, corner wear, sticker residue and scuffed blisters.
Packaging is part of how a model ships, not something we guarantee the condition of. Boxes and blisters take handling damage in transit and we do not treat that as a fault in the model.
Product photography is illustrative. Colours vary between screens, and where a listing uses a manufacturer photo the production model may differ from it.
What we do not cover:
- Quality-control claims. We do not operate a QC claims, inspection, grading or replacement scheme. There is no unboxing-video claim process, and we do not offer compensation for the variation described above.
- Manufacturing defects. Models are made by third-party manufacturers and we do not manufacture, rework or warrant them. A fault originating in manufacture is not something we replace, refund or compensate for. Where a manufacturer operates its own warranty, any claim is between you and them.
- Damage in transit (DIT). A parcel damaged after it leaves us is not covered as standard.
- Loss in transit (LIT). A parcel lost, misrouted or undelivered by the courier is not covered as standard, and we do not replace or refund it.
DIT and LIT are the two cover can be bought for, and only before you order — see Transit cover. Without it, risk in transit sits with you. We will always help you chase a courier, but doing so is not an acceptance that the loss is ours.
These exclusions apply as far as the law allows. Where consumer law gives you a right that cannot be contracted out of, that right stands whatever this page says — here as on any other site, because a term cannot remove it.
12Returns and refunds
All sales are final. We do not accept returns or exchanges and we do not refund for a change of mind, an ordering mistake, a model that turned out not to suit your collection, or the collectible variation described above.
The cases where we do refund are set out in these terms and are:
- we cancel or cannot fulfil your order, in whole or in part;
- a pre-ordered model is cancelled by the manufacturer or cannot be supplied;
- a pre-ordered model has not reached us within 12 months of its stated arrival date;
- a statutory tax or duty change means you would pay more than you agreed;
- a right under consumer law entitles you to one.
Refunds go back by the route the payment came in, within a reasonable period of us agreeing the refund.
13Intellectual property
The layout, text, artwork and photography on this site are ours or our licensors’ and may not be copied, republished, resold or scraped without written permission. You may use the site for your own personal, non-commercial purposes.
Manufacturer names, logos and model names — and the marques of the vehicles the models depict — are the trademarks of their respective owners. We use them to identify the products we sell. Nothing here claims ownership of them or implies that we are endorsed by or affiliated with any manufacturer or marque.
14Acceptable use
Do not use this site unlawfully, do not attempt to break, overload or gain unauthorised access to it, do not scrape it or use automated tools to buy allocation-limited releases, and do not misrepresent who you are. You must be old enough to enter a binding contract where you live.
15Your information
To run your account and your orders we hold your name, email address, password in hashed form, and — where you give them — your phone number, delivery addresses, an optional address for receipt copies, your saved cart and wishlist, and your order history.
We share what a delivery needs with the courier, and nothing more than that. We do not sell your personal information.
The site stores small amounts of data in your browser for things like your cart, your currency and your light or dark preference. You can ask us to correct your details or to close your account; we keep order records for as long as tax and accounting rules require, which we cannot delete on request.
Our Privacy Policy sets all of this out in full, including what we deliberately do not collect and who else sees your data.
16Our liability
We are responsible for supplying the model you ordered. Where we are liable, our liability for an order is limited to what you paid for the affected items.
We are not liable for indirect or consequential loss, for loss of profit or of the value of a collection, or for a model failing to hold or gain resale value.
We do not exclude liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded — including your rights under consumer law.
17Events outside our control
We are not in breach of these terms where we are prevented or delayed by something outside our reasonable control, including natural events, fire, flood, epidemic, war, civil disturbance, industrial action, courier or customs failure, manufacturer or supplier failure, government action, power failure or a cyber incident. Where such an event continues long enough to defeat the point of an order, either of us may cancel it and you will be refunded for anything undelivered.
18Changes to these terms
We may update these terms. The version published when you place an order is the version that governs that order, so a later change does not alter a contract already made. The date at the top of this page is when it last changed.
19Governing law
These terms are governed by the laws of India, and the courts at [city] have exclusive jurisdiction over any dispute. If any part of these terms turns out to be unenforceable, the rest continues to apply. Our not enforcing something on one occasion does not waive it.
